Privacy Policy — iOS

This Privacy Policy (hereinafter this "Policy") sets forth the manner in which Shosin Labs, an independent software studio (hereinafter the "Developer") handles information in connection with the website operated by the Developer and the Murmur application for iOS (hereinafter the "Application").

Article 1 (Purpose)

This Policy sets forth the categories of information processed by the Developer in connection with the Application and the website operated by the Developer, the purposes for which and the manner in which such information is processed, the third parties by which it is processed, the locations in which it is processed and retained, and the means by which the User may have such information deleted.

Article 2 (Definitions)

In this Policy, the following terms shall have the meanings set forth below:

• (a) "User" means any person who installs or uses the Application;
• (b) "User Content" means the recordings, transcripts, speaker data and notes created by the User with the Application;
• (c) "Cloud Transcription" means the optional function of the Application by which the audio of a recording selected by the User is transcribed outside the device of the User, as set forth in Article 4;
• (d) "Account" means the account created with the Developer when the User signs in with a Google account in order to use Cloud Transcription; and
• (e) "Usage Data" means the usage statistics and crash reports collected as set forth in Article 6.

Article 3 (Processing on the Device)

User Content shall be stored on the device of the User. By default, transcription, speaker identification and translation are performed on the device of the User. The Application uses the microphone solely while the User is recording.

Article 4 (Cloud Transcription)

Cloud Transcription may be selected by the User for an individual recording and requires that the User sign in with a Google account. Where the User selects Cloud Transcription, the Developer shall use the transcription service of Groq, Inc. (hereinafter "Groq"), located in the United States, to transcribe the audio of the recording concerned, as set forth in Article 5.

The Developer shall retain the audio, the transcript and a record of the request for a period of 30 days for the purposes of investigating problems and verifying the usage of the User, upon the expiry of which period such data shall be deleted automatically.

Notwithstanding the foregoing, speaker identification shall be performed on the device of the User in all cases, and speaker data shall not be uploaded. Upon the deletion of the Account, the data set forth in the preceding paragraph shall be deleted immediately.

Article 5 (Service Providers and Location of Processing)

The Developer uses the service of Groq, which is located in the United States, to provide Cloud Transcription. Groq is not permitted to use the audio or the transcript to train its models.

By selecting Cloud Transcription, the User consents to the transfer to the United States of the data set forth in Article 4. Information on the laws for the protection of personal information in other countries is published by the Personal Information Protection Commission of Japan at ppc.go.jp. With respect to Users in the European Economic Area, the United Kingdom and Switzerland, such transfers are made in reliance on Standard Contractual Clauses or an equivalent safeguard.

Article 6 (Usage Data)

The Application uses Google Firebase Analytics and Crashlytics to collect Usage Data, including information on the manner in which the Application is used, the device model, the operating system version, the version of the Application and the language. Usage Data is associated with a random identifier assigned to the installation of the Application and shall be used solely for the purposes of understanding and improving the Application.

Article 7 (Backup and Synchronisation)

On iOS, the User may synchronise recordings and transcripts through the iCloud account of the User. The User may disable such synchronisation in the settings of the Application.

Article 8 (Advertising)

The Application contains no advertising and does not use an advertising identifier.

Article 9 (Third-Party Service Providers)

The Developer uses Google Firebase for the collection of Usage Data (see Firebase privacy information) and Groq for Cloud Transcription, as set forth in Article 5.

Article 10 (Children)

The Application is not directed at children.

Article 11 (Deletion)

The User may delete any recording, transcript or speaker within the Application, and the uninstallation of the Application shall delete the data stored by the Application on the device. A User who has signed in may delete the Account within the Application, whereupon the data relating to Cloud Transcription shall also be deleted.

A request for the deletion of Usage Data associated with the installation of the Application may be submitted to the Developer at the address set forth in Article 13.

Article 12 (Amendment of this Policy)

The Developer may amend this Policy from time to time. In the event of any such amendment, the Developer shall revise the date set forth at the top of this page.
